Article 1 - Application of the conditions

The seller is defined below as being the online store passionchrono.com: commercial sign of the company TILMAWEB SARL, whose registered office is at the following address: TILMAWEB SARL - BP 80450 - 17207 Royan cedex FRANCE, Company registered with the French RCS of Versailles under number 750 413 882

The buyer is defined below as the company or person signing and accepting these conditions of sale.

The buyer acknowledges having the capacity to contract under the conditions described below, i.e. being of legal majority and not being under guardianship or curatorship. The buyer acknowledges having read these T&Cs before placing the order. The general conditions of sale apply exclusively to all sales concluded by the company PassionChrono.com, both for its own account and for that of its principals. All other conditions only bind the seller after written confirmation from him. The mere fact of placing an order or accepting an offer from the seller implies the unreserved acceptance of these general conditions. Any condition not in accordance with our general conditions that the buyer has formulated will be rejected unless we have expressly and in writing acknowledged their applicability.

These general conditions may be modified at any time and without notice by the company Passion Chrono, the modifications then being applicable to all subsequent orders.

Article 2 – Orders

Orders are effective from the date of receipt of payment. Orders sent directly by the buyer or transmitted by the seller's representative agents only bind the seller when they have been accepted in writing. The object and terms of the sale are only valid insofar as they appear in the offer or the confirmation made by the seller.

Any offer to sell is subject to available stocks. However, if despite the vigilance of the seller concerning its stocks, the products prove to be unavailable after the buyer's order, the company PassionChrono undertakes to inform you as soon as possible, and may allow you to cancel or to modify your order.
In the event that the payment for the buyer's order has already been debited by the seller, and no modification of the said order seems to be possible, the buyer will be refunded without delay and at the latest within 30 days of payment of the sums he has paid.

Any clause emanating from the buyer, not accepted in writing by the seller which would be in opposition to the present general conditions or particularities defined in the price offer will be considered as null.
Any unilateral cancellation of order must be accepted by PassionChrono.

Article 3 – Price and Stock

The prices of the site are indicated in Euros all taxes included for metropolitan France and the countries of the European Union. They are applicable during the validation of the order by the consumer and do not include the participation in the delivery costs, invoiced in addition, and indicated before the final validation of the order form. Our product offers and prices are valid as long as they are visible on the site, within the limits of available stocks.

Concerning products with delivery times and not showing the indication "In Stock", these are valid subject to availability from our suppliers. Indications of product availability are then provided when placing your order.

As this information comes directly from our suppliers, errors or modifications may exceptionally occur. Regarding promotional codes, these cannot be combined and only one can be used per order.

Article 4 – Payment

All orders are payable in Euros. Payment of the full price must be made when ordering by the Buyer. At no time can the sums paid be considered as a deposit or down payment.

To pay for his order, the Buyer has all the means of payment referred to in the order form: bank card (credit card, Mastercard, Visa), bank check, postal or PayPal. The buyer guarantees to the company PassionChrono that he has the necessary authorizations to use the method of payment he has chosen, when registering the order form.

The PassionChrono company reserves the right to suspend or cancel any order and/or delivery, whatever their nature and level of execution, in the event of non-payment of any amount due by the Buyer , or in the event of a payment incident. Penalties of an amount equal to the legal interest rate plus five points are automatically applicable to amounts unpaid at the end of a period of ten days following the invoice date or upon notification of the rejection of bank payment for any other means of payment.

The delivery of any new order may be suspended in the event of late payment of a previous order, notwithstanding the provisions hereof. PassionChrono reserves the right to request a photocopy of the buyer's identity card and/or proof of address for any order.

As part of the fight against Internet fraud, information relating to your order may be checked for verification.

Article 5 – Choice of Articles

The buyer, having taken knowledge of the products and their characteristics, marketed by the company PassionChrono, has under his sole responsibility and according to his needs as he has previously determined them before any order, made his choice on the or the products ordered.

In addition, the Buyer, knowing only the accessories, accessory packs, spare parts, software and others, that he uses, is the sole judge of the compatibility of the products ordered with those used by him. It is exclusively up to the buyer, if he does not consider himself sufficiently competent, to seek the assistance of counsel.

Items 6 – Delivery

General Rules

The products will be delivered to the address indicated by the buyer on the order form. The buyer can, at his express request, obtain the sending of the invoice to the billing address and not to the delivery address by simply making the request to the seller in writing, fax or email.

To allow the ordered products to be sent to the buyer, the PassionChrono company has chosen to work primarily with the POSTAL POST office using the POSTAL COLISSIMO TRACKING system or with the POSTAL POSTAL CHRONOPOST system for faster shipments in the case of orders placed before 4 p.m.; in order to reduce transport times between the order and the delivery of the ordered products.

The characteristics of the Colissimo Suivi de la POSTE system are as follows: The buyer has the option of picking up the products ordered at the post office closest to the delivery address, in the event of absence, at the of delivery, when the postman is presented. The buyer is delivered to his home by his postman and signs an acknowledgment of delivery slip.

In case of absence, the buyer or the recipient of the ordered product receives a delivery notice from his postman, which allows him to collect the ordered products, at the nearest post office, for a period of fifteen days.

Delivery Problems

The buyer is required to check, in the presence of the postal worker, the condition of the packaging of the goods and its contents on delivery.

In the event that the buyer has any doubt whatsoever about the condition or content of his package, he is required to:

  • to apply the Colissimo procedure (in particular to report the damage due, all complaints and reservations) and to refuse the goods by immediately issuing a report of anomaly to the post office employee.
  • to report these incidents to the company PassionChrono via its online customer service free of charge via the internet interface within two working days, and this by exposing the said complaints or reservations.

Failure to comply with the procedure set out above, no complaint from the buyer will be accepted. It is also recalled that our sales department is at your disposal for any pre-sales advice, additional information, comments, order taking... by telephone on +33 6 58 50 24 15.

Article 7 - Problem of non-receipt of order

A shipping confirmation email containing the tracking number of the package is sent to the buyer by PassionChrono when the order is shipped. The buyer is then required to follow the routing and delivery of his order via the carrier's website.

In the event of a complaint, it must be made within 10 working days of the dispatch of the order. No complaint can be taken into account beyond this period.

- Deadlines:

The POSTAL Colissimo Tracking system allows delivery within an average of 48 to 96 hours (2 to 5 days) from the PassionChrono depot. The starting order is given by the company PassionChrono after full receipt of the price of the order. This deadline is communicated as an indication and any possible overrun cannot give rise to damages.

The PassionChrono company undertakes to indicate, before the conclusion of the contract, the deadline by which it undertakes to deliver the goods. Failing this, the company is deemed to have to deliver the goods or perform the provision of services upon conclusion of the contract. In the event of non-compliance with this deadline, the customer may obtain the resolution of the sale under the conditions provided for in the second and third paragraphs of Article L. 114-1. It will then be reimbursed under the conditions of article L. 121-20-1 unless the latter prefers to obtain the exchange for an equivalent available product at an equivalent price.

In any event, and in accordance with the provisions of Article L 121.20.3 of the Consumer Code, the products ordered will be delivered within a maximum period of thirty days from the day following that on which the buyer registered his order, subject to full payment of the price. In the absence of delivery at the end of this period, the buyer will have the possibility of canceling his order. All sums paid by the buyer will then be returned to him without delay, excluding any other compensation.

In the event of a delay in delivery in relation to the date initially fixed, the buyer must report it in writing (mail, fax, email) to the company PassionChrono, in order to improve the quality of service which may be proposed and to allow the seller to carry out an investigation with the POST OFFICE. An investigation with the POSTE can last up to 21 working days. If during this period, the product is found, it will be immediately forwarded to the home of the buyer or the recipient designated in the order form.

On the other hand, if the product ordered is not found at the end of this period of 21 days of investigation, the company PassionChrono will proceed at its expense to a new shipment of the products ordered by the buyer.

Article 8 - Right of withdrawal

You have the right to withdraw from this contract without giving any reason within fourteen days. The withdrawal period expires fourteen days after the day on which you, or a third party other than the carrier and designated by you, takes physical possession of the last good.

To exercise the right of withdrawal, you must notify us of your decision to withdraw from this contract by means of an unambiguous declaration (for example, letter sent by post, fax or e-mail) by post to the address TILMAWEB SARL - BP 80450 - 17207 Royan cedex FRANCE. by phone on +33 6 58 50 24 15 or via our contact form.

For the withdrawal period to be respected, it is sufficient that you send your communication relating to the exercise of the right of withdrawal before the expiry of the withdrawal period. You must return or return the goods to TILMAWEB SARL - BP 80450 - 17207 Royan cedex FRANCE, without undue delay and, in any event, no later than fourteen days after you have communicated your decision to withdraw from this contract to us. This deadline is deemed to have been met if you return the goods before the expiry of the fourteen-day period. You will have to bear the direct costs of returning the goods.

Effects of withdrawal

If you withdraw from this contract, we will refund all payments received from you, including delivery costs (except for additional costs arising from the fact that you have chosen, if any, a delivery method other than the less expensive standard delivery method offered by us) without undue delay and, in any event, no later than fourteen days from the day on which we are informed of your decision to withdraw from this contract.

We will make the refund using the same means of payment as you used for the initial transaction, unless you expressly agree to a different means; in any case, this reimbursement will not incur any costs for you.

We may defer reimbursement until we have received the goods or until you have provided proof of shipment of the goods, whichever date is first.

Article 9 – Retention of Title

In application of the law of May 12, 1980, the transfer of ownership of the goods delivered to the buyer will only take place after full payment of the principal and accessory price or the cashing of accepted checks or other means of payment issued for the purpose of settlement of the price.

During the period from delivery to transfer of ownership, the risk of loss, theft or destruction is the responsibility of the buyer. Failure by the buyer to fulfill his payment obligations, for whatever reason, gives the seller the right to demand the immediate return of the goods delivered at the expense and risk of the buyer.

Article 10 – Warranty

The products are guaranteed by the manufacturer (failing this, by the company PassionChrono) against any material or manufacturing defect for a period of 12 months from the date of delivery, except for specific conditions expressly indicated. Interventions under the guarantee cannot have the effect of extending the duration of the guarantee, unless the period of immobilization exceeds a period of 7 days, beyond which the guarantee period is then extended in proportion to the days of additional immobilization.

Any return of the product under the aforementioned guarantee must be subject to the prior agreement of PassionChrono. To this end, the buyer will contact the seller's after-sales service, whose contact details will be indicated on a page of the seller's website provided for this purpose. No returns will be accepted without the prior agreement of the seller.

The defective product must be returned in its original packaging accompanied by a copy of its purchase invoice, include all of the product and its accessories as well as the serial number of the product when it is has one. All costs and risks associated with returning the product are the responsibility of the Buyer.

Warranties do not cover normal wear and tear of a product, replacement of consumables; abnormal, illicit or non-compliant use of the products; failures related to accessories; damage resulting from abnormal shocks, operating errors or modifications made by the buyer; failures caused by negligence, deterioration or improper use; defects and consequences due to the intervention of a repairer not approved by the company PassionChrono as well as defects and consequences related to any external cause. In this specific case, the product may be returned to you as is, or repaired upon acceptance and prior payment of an estimate established by the manufacturer.

It is recalled that PassionChrono cannot be held responsible in the event of the manufacturer's refusal to apply its guarantee for the legitimate reasons set out above. In any case, the manufacturer's warranty and the subscription of an additional warranty do not deprive the buyer and/or the consumer of the provisions of the legal guarantees (in particular the guarantee against hidden defects or the legal guarantee of conformity). The legal guarantee of conformity applies in any case for the consumer.
